1. Who we are

Dexicon is operated by Dexicon, a sole proprietorship (eenmanszaak) established in the Netherlands.

One address, on purpose. support@dexicon.app is where everything comes in: questions, complaints, requests about your personal data, reports of unlawful content and notices from rights holders. It is also our single electronic point of contact for users and for authorities under the Digital Services Act (art. 11 and 12). We would rather give you one address that is read every day than three that look tidy, and we route your message internally. You can also reach us through the report and support screens inside the app. We communicate in English and Dutch.

2. The service and these Terms

Dexicon is a collection tracker, price guide and peer-to-peer marketplace for Pokémon TCG collectors.

These Terms, together with the Marketplace & Trading Rules, the Community Guidelines and the Cookie Policy, form the agreement between you and Dexicon. The Privacy Policy explains how we handle personal data; it is not a contractual term but it is part of what you are told before you agree. Where these Terms and the Marketplace & Trading Rules differ on a marketplace topic, the Marketplace & Trading Rules prevail.

You accept these Terms and the Privacy Policy when you create an account. You accept the Marketplace & Trading Rules before your first marketplace action, and the Community Guidelines before your first post or comment. Each acceptance is recorded with the document version, the date and how you accepted it, and you can look all of it up in the app.

Plain language. We write these documents to be read. If a passage is unclear, ask us at support@dexicon.app and we will explain it — and if the explanation is better than the text, we change the text.

3. Early access

Dexicon is in an early-access phase. Features may change, be interrupted or be withdrawn, and we do not promise uninterrupted availability or error-free operation. We fix problems as soon as we reasonably can.

This section does not take away any right you have under mandatory law. In particular, if you subscribe to Dexicon Pro, the statutory conformity requirements for paid digital services apply in full (art. 7:50aa et seq. of the Dutch Civil Code, implementing Directive (EU) 2019/770): Pro has to be what a reasonable subscriber may expect of it, and we cannot contract that away. "Early access" describes the free service; it is not a disclaimer against your consumer rights.

4. Eligibility, age and minors

  • You can create an account and use the collection tools at any age.
  • The marketplace, chat and community features require you to be 16 or older. Sixteen is the age the Netherlands has set under art. 8 GDPR (art. 5 UAVG). Below 16 these features are not shown and cannot be used.
  • You must give an accurate date of birth. Misrepresenting your age is grounds for suspension. Your date of birth can only be corrected through support, so that it cannot be used as a switch to get around the age limit.
  • For users under 16, every optional processing purpose (marketing, analytics, personalised recommendations) is switched off and cannot be switched on.
  • Under-16 accounts. We only process what the collection tools need. A parent or legal guardian can ask us to review, export or delete such an account by writing to support@dexicon.app.
  • Minors and paid services. If you are under 18, you may only take a Dexicon Pro subscription with the permission of your parent or legal guardian (art. 1:234 of the Dutch Civil Code). If we learn that permission was missing, we cancel the subscription and refund the unused period.

5. Your account

  • One account per person. Keep your credentials secure; you are responsible for what happens on your account. You can use several devices and sign out any device individually.
  • Transactional messages cannot be switched off. Account e-mails (verification, password reset) and messages about your payments, orders, shipping, disputes and account security are part of operating the service. Every other notification category is optional.
  • Deleting your account. You can delete your account at any time from inside the app (Settings → Privacy & data). It becomes invisible immediately and enters a 30-day grace period, during which signing in restores it completely. After 30 days the deletion is permanent.
  • Deleting it without the app. You do not need the app to get rid of your account. The same screen is reachable on the web at dexicon.app/settings/privacy, and you can always ask us to delete the account and its data by writing to support@dexicon.app from the address on the account. We confirm when it is done.
  • Open deals first. You cannot close your account while you have open marketplace deals; the app shows which ones. This does not take away your right to erasure: it means the personal data needed to complete or settle an open deal is kept until it is settled, because we need it for the performance of that contract and for the establishment or defence of legal claims (art. 17(3)(b) and (e) GDPR). Everything else is deleted on the normal schedule, and data we must keep by law is kept only for the periods in the Privacy Policy.

6. Free and Dexicon Pro

  • The core service is free, permanently, with usage limits. There is no trial and no advertising in either tier.
  • Dexicon Pro is an optional paid subscription (monthly or yearly) that lifts those limits. Pro never gates the marketplace itself.
  • Prices are shown in full, including any VAT, before you subscribe.
  • Where you buy it. In the mobile apps, Pro is an in-app purchase: the app store is the seller and its own terms and refund policy apply to that purchase. On the web, Pro is paid through our payment service provider and you buy it from us.
  • Renewal and cancellation. Pro renews automatically at the end of each period unless you cancel. You can cancel at any time and Pro then runs until the end of the period you already paid for; after that nothing is charged. Cancelling never removes what you already have — if you end up above a free-tier limit you keep everything, you just cannot add beyond the limit until you are under it again.
  • Price changes to an existing subscription are announced at least 30 days in advance. If you do not want the new price, cancel before it takes effect.
  • Your 14-day right of withdrawal (web purchases). As a consumer you can withdraw from a Pro subscription bought on the web within 14 days, without giving a reason, by writing to support@dexicon.app or using the withdrawal form in the app.
  • If you ask us to start Pro immediately — which you do by ticking the box at checkout — you expressly request performance during the withdrawal period and you acknowledge that the right of withdrawal ends once the subscription has been fully performed.
  • If you withdraw while the period is still running, you owe a proportionate amount for the days you had Pro, and we refund the rest within 14 days (art. 6:230s(4) of the Dutch Civil Code).
  • App-store purchases follow the app store's own refund process, which we cannot overrule.

7. Your content

You keep ownership of the photos, notes, reviews and posts you create.

You grant Dexicon a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content for the purpose of operating and securing the service — for example showing your listing photos to buyers, or keeping dispute evidence available to both sides. The licence lasts as long as we need it for that purpose and for the retention periods in the Privacy Policy, and it ends when the content and those periods do.

We do not use your content in advertising or external marketing without asking you first. If we would like to show your collection, a photo or a post outside the app, we ask for your separate permission, and you can withdraw it. Where a photo shows a recognisable person, we also need that person's permission (art. 21 of the Dutch Copyright Act).

Do not upload content you have no right to share. Photos submitted as part of a deal (listing photos, proof of packing, dispute evidence) can be kept for the periods in the Privacy Policy even after you delete them elsewhere, where that is needed for dispute handling or a legal obligation.

8. Collection data and prices — information, not advice

Card prices, values, trends and any figure derived from them are estimates based on third-party market data, shown for information only. They are not an offer, a valuation, an appraisal, or financial, investment or tax advice. We do not guarantee that they are accurate or complete, or that any card will sell at any price. Where a value is unknown, the app says so instead of showing a number.

9. The marketplace — what Dexicon is and is not

This section summarises the model. The Marketplace & Trading Rules contain the full rules and prevail over this section.

  • Every purchase or trade is a contract between the buyer and the seller. Dexicon is exclusively a distance intermediary: we provide the platform on which private collectors find each other and transact. Dexicon is not a party to any sale or trade, does not act as buyer, seller, agent or auctioneer, never takes possession of any card or product, and never physically inspects an item.
  • Dexicon never holds your money. All payments are processed by Mollie B.V., a payment service provider licensed and supervised in the Netherlands. Buyer payments are held by Mollie in segregated, escrow-style balances until the release conditions in the Marketplace & Trading Rules are met. Identity checks on sellers, safeguarding of funds and chargebacks are performed by Mollie under its own terms, which sellers accept during verification.
  • Sellers are private individuals, not traders. Acting as a business seller is not allowed (Marketplace & Trading Rules §3). This has a consequence you should know before you buy: consumer sales law — including the statutory conformity guarantee and the 14-day right of withdrawal — does not apply between two private individuals. What protects you instead is the platform's own procedure: the money is held, you get a check window after delivery, and there is a return and dispute route. Those are contractual promises from Dexicon to you, not statutory consumer rights, and §12 of the Marketplace & Trading Rules says exactly how far they reach.
  • The Payment fee is a service Dexicon sells to the buyer. The buyer pays a fixed fee per order (Marketplace & Trading Rules §5). Selling on Dexicon is free. Because that fee is a contract between you and us, you have a 14-day right of withdrawal on it — and at checkout you expressly ask us to start protecting the order right away, which means the right ends once the protection has been fully provided. Marketplace & Trading Rules §5 sets this out in full, including when we refund the fee anyway.
  • A dispute decision is a payment instruction and nothing more. Where Dexicon decides a dispute, that decision only says where the held amount goes. It is not a judgment on the underlying sale, it does not establish fault or ownership, and it never limits either party's right to go to court or to any other lawful body.

10. Acceptable use

You must not: use the service unlawfully; scrape or bulk-access data; reverse engineer the app; distribute malware; get around fees, escrow, verification or safety systems; create fake accounts; manipulate prices, reviews, leaderboards or matching; or ask other users to pay or trade outside the platform's protected flow.

11. Intellectual property

The Dexicon app, brand, design and database structure are protected.

Pokémon, Pokémon TCG, card images and card names are trademarks and copyrights of Nintendo, Creatures Inc., GAME FREAK and The Pokémon Company (International). Dexicon is a fan-built, independent service. It is not produced by, affiliated with, sponsored by or endorsed by any of these companies. Card names and images are used only to identify the cards you own or trade, and for no other purpose.

If you own rights and you think we are infringing them. Write to support@dexicon.app with: what the work or mark is, where in Dexicon it appears (a link or a screen name is enough), why you believe it is unlawful, and how we can reach you. We assess every notice, we act on the ones that are justified, and we tell you what we did. If the material was posted by a user we also inform that user and they can object, so that a wrong notice can be corrected. This route is open to rights holders and to anyone else; it is the same notice-and-action mechanism as §12.

12. Safety, reports, moderation and appeal

  • Reporting. Anyone can report content, listings, reviews, chat messages or users through the in-app report flow, or by writing to support@dexicon.app. This is our notice-and-action mechanism under art. 16 of the Digital Services Act. We confirm receipt, we assess the report, and we tell the reporter what the outcome was.
  • Blocking. You can block another collector at any time. A block is mutual and silent: you disappear from each other's feed, boards, matching, chat and search. You do not need a reason and we do not tell the other person.
  • What we do and do not check in advance. Dexicon is a hosting service for content that users create. We do not read or screen everything in advance, and no law requires us to (art. 8 DSA: no general monitoring obligation). What we do instead: §10 and the Community Guidelines say what is not allowed; a post has to be anchored to a real item from the catalogue, so it is not a blank text box; a listing passes an automated check before it can go live; every surface carries a report button; and reported content is reviewed by a human, who can remove it and act against the account.
  • Statement of reasons. If we remove content or a listing, or we warn, restrict, suspend or ban an account, the affected user gets a statement of reasons saying what was decided, on what ground, and what can be done about it (art. 17 DSA).
  • Appeal. You can appeal any moderation decision once through the in-app complaint flow, and a human reviews it — never an automated system alone. Dexicon is a micro-enterprise and is therefore exempt from Section 3 of the DSA, which includes the obligation to run an internal complaint-handling system (art. 19 DSA). We run one anyway, along the lines of art. 20 DSA, because a sanction without a route back is not a fair sanction. If we ever grow past that exemption, the obligations start applying and we will say so here.
  • Our position on user content. Content on Dexicon is created by users, not by us. We store and display it on their instruction. Where we do not know that something is unlawful, and where we act promptly once we do, we are not liable for it (art. 6 DSA). That is exactly why the report route above matters: it is how you tell us, and it is how we can act.
  • Courts and authorities. Nothing in this section stops you from going to court. Serious illegality is reported to the competent authorities where the law requires it.

13. Liability — who carries what

Dexicon is a platform. It is not the seller, not the buyer, not the carrier and not the bank. This section says who carries which risk, and it says it plainly because a vague version helps nobody.

What we never exclude. Nothing in these Terms excludes or limits our liability for death or personal injury, for intent or conscious recklessness (opzet of bewuste roekeloosheid), for fraud, or for anything else that cannot be excluded or limited under mandatory law. Your mandatory consumer rights, and your rights under data protection law, are untouched by this section.

What we are liable for. Outside those cases, our liability towards you is limited to direct damage and is capped at the higher of (a) the amounts you paid us for Dexicon services in the 12 months before the event — subscription fees and Payment fees — and (b) €250. We chose a floor rather than a zero cap on purpose: a clause that leaves a user who happened to pay nothing with no remedy at all is the kind of clause a Dutch court sets aside (art. 6:233 and 6:237 of the Dutch Civil Code), and a term we could not defend is worth nothing to either of us.

What we are not liable for. We are not liable for: the conduct, listings, descriptions or content of other users; the condition, authenticity, provenance or value of any card or product, since we never possess or inspect items; loss, delay or damage during transport; the acts or omissions of Mollie or any other payment provider acting under its own licence and terms; price data and valuations (§8); the acts or omissions of an app store, a device manufacturer or an operating system; or indirect damage, consequential loss, lost profit, lost opportunity or lost data. Keep your own copy of what matters to you — the export in Settings → Privacy & data gives you a complete one at any time.

The goodwill buffer is not insurance. Any payment Dexicon makes from its goodwill buffer — for example a lost-parcel payment to a seller, or a correction after a successful objection — is a discretionary gesture. It is not an insurance product, it is not an obligation, and receiving one does not create a right to another. See Marketplace & Trading Rules §10 and §12.

Circumstances beyond our control. We are not in breach where performance is prevented by something we cannot reasonably control (art. 6:75 of the Dutch Civil Code): an outage at our hosting, payment, e-mail or shipping providers, an internet or network failure, a cyber attack, a strike, an act of an authority, or a natural event. We tell you what is going on and we pick things up again as soon as we can. If such a situation lasts longer than 30 days, either of us can end the agreement, and we refund any part of a paid Pro period you did not get.

Tell us in time. If you think we owe you something, tell us as soon as you reasonably can after you notice it, and in any event within one year, so that we can still look into what happened. This does not shorten any statutory period below what the law allows (art. 6:236 sub g of the Dutch Civil Code), and it does not apply where we acted with intent or conscious recklessness.

14. Your responsibility towards third parties

You are responsible for your own listings, content, trades, shipments and tax position. If someone else — another user, a rights holder or an authority — brings a claim against Dexicon that is caused by something you did or failed to do, and you were at fault, you carry the consequences of that claim, up to what you can reasonably be held to under Dutch law. This never applies to the extent the claim is caused by our own intent or gross negligence, and it never sets aside a mandatory consumer right.

15. Suspension and termination by Dexicon

We can suspend or end an account for a material breach of the agreement, following the sanctions ladder in the Marketplace & Trading Rules and the Community Guidelines, with notice and a statement of reasons where that is reasonably possible, and always with the appeal route of §12. Held funds from ongoing deals are still completed or refunded under the Marketplace & Trading Rules, even for a suspended account: a sanction against a person is not a reason to keep somebody's money.

16. Changes to these Terms

  • We may change these Terms — for example to reflect a change in the law, in the service, or in the way payments or shipping work.
  • We announce a material change at least 30 days in advance, through the in-app banner and the version and date at the top of this document.
  • A new version applies to you once you accept it in the app. Until then you keep using the version you accepted.
  • If you do not accept, you can export your collection data and close your account, at no cost. If you had a paid Pro period running, we refund the unused part of it. Deals that were already paid for are finished under the version that applied when you paid.

17. Complaints, applicable law and competent court

  • Complaints first. Write to support@dexicon.app, or use the in-app complaint flow. We answer as soon as we can, in English and Dutch. If you are not satisfied with our answer, you can take the matter further as described below.
  • Applicable law. Dutch law applies. If you live in another EU or EEA country, this does not take away the protection of the mandatory consumer rules of the country where you live (art. 6 Rome I).
  • Out-of-court dispute resolution. The European ODR platform was discontinued on 20 July 2025 and no longer exists. Dexicon is not affiliated with a certified dispute committee, so we cannot point you at one; if that changes we will say so here. Consumers in the EU can get free advice from their national consumer authority or from the European Consumer Centre in their country (eccnet.eu). In the Netherlands you can also contact ConsuWijzer.
  • Court. You can always bring a dispute before the competent court. As a consumer you may bring your claim before the court of the country where you live, and we will only bring a claim against you before the court of the country where you live (art. 17–19 of Regulation (EU) 1215/2012).

18. If you got the app from the App Store or Google Play

Dexicon runs on the web and as an app you install from Apple's App Store or Google Play. If you installed it from a store, this section applies on top of everything above. It is written to meet the minimum terms those stores require, and none of it takes away a right you have under mandatory consumer law.

  • This agreement is with us, not with the store. These Terms are concluded between you and Dexicon only. Apple and Google are not a party to them. We alone are responsible for Dexicon and for everything in it.
  • What you may do with the app. You get a personal, non-transferable, revocable licence to use Dexicon on devices you own or control, in line with the usage rules of the store you got it from. You may not resell, rent out, redistribute or sublicense the app.
  • Support. We provide all support and maintenance for Dexicon; Apple and Google have no obligation to. Support runs through support@dexicon.app and the in-app support screen.
  • Warranty. We alone carry any warranty for the app, and your statutory rights against us remain in full. If the app fails to conform to a warranty and you bought it from the App Store, you may notify Apple and Apple will refund the purchase price of the app to you; beyond that refund, Apple has no warranty obligation regarding Dexicon. The same principle applies to Google Play under its own terms.
  • Claims about the app. We, not the store, are responsible for dealing with any claim from you or a third party relating to Dexicon: that it does not conform, product liability, any failure to meet a legal or regulatory requirement, and any claim under consumer protection, privacy or similar law.
  • Intellectual property claims. If a third party claims that Dexicon infringes their intellectual property rights, we, not the store, are responsible for investigating, defending, settling and discharging that claim.
  • Where you are. By using Dexicon you confirm that you are not located in a country subject to a United States Government embargo or designated by that government as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties. The stores require us to ask this; it is not a judgement about you.
  • Other people's terms. You also have to keep to the terms of any third-party service you use Dexicon with, including the terms of the store itself and of your device and operating system.
  • The stores may enforce this section. Apple and its subsidiaries, and Google and its subsidiaries, are third-party beneficiaries of these Terms. When you accept these Terms they get the right to enforce them against you as a third-party beneficiary, and they are deemed to have accepted that right.
  • Purchases in the app. Dexicon Pro bought inside the mobile apps is an in-app purchase: the store is the seller, its terms and its refund policy apply, and you manage or cancel the subscription in your store account. Cards, products, shipping and the Payment fee are not in-app purchases and never run through store billing: they are physical goods and a service between you, another collector and our payment provider, exactly as §9 and the Marketplace & Trading Rules describe.
  • The store is not the marketplace. Apple and Google play no part in a sale or trade between collectors, hold none of the money, and carry no responsibility for it.
